1. Introduction
Welcome to OpenRegistryPortal ("Company," "we," or "us"). These Terms & Conditions ("Terms") regulate your use of our website at openregistryportal.sbs (the "Service") and yacht charter services provided by OpenRegistryPortal.
When you reserve a yacht or utilize our Service, you accept these Terms. If you do not agree with any part of these terms, you are prohibited from using the Service.
2. Service Overview
OpenRegistryPortal offers high-end yacht charter solutions, including:
- Yacht rentals for the day
- Evening boat tours
- Corporate outings
- Exclusive events
- Long-term charters
We may alter or cease services without notice and all services are dependent on availability and weather conditions.
3. Booking and Reservations
3.1 Booking Process
You must follow these steps to secure a booking:
- Reach the age of majority (18+ years old)
- Supply complete and confident information
- Make an initial deposit payment as per your booking confirmation
- Consent to the stipulated Terms & Conditions
3.2 Confirmation
Bookings are officially confirmed only after we receive your payment and issue a written confirmation. We retain the discretion to reject any booking.
3.3 Availability
Charter bookings are subject to yacht availability and suitable weather. We will strive to fulfill your preferred scheduling requests.
4. Payment Terms
4.1 Pricing
Our quoted prices are in € and include any relevant taxes unless specified otherwise. Prices can change with no prior notification.
4.2 Payment Schedule
- Initial deposit: 50% of the full charter price, payable at the time of booking
- Remaining balance: Due 48 hours before the start of the charter
- Any additional costs (if applicable): Payable upon charter conclusion
4.3 Payment Methods
We accept several payment methods, including major credit cards, direct bank transfers, and certified cheques, through encrypted, secure payment processors.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If cancelling more than 72 hours before departure: We will issue a complete refund minus any processing expenses
- Between 24 to 72 hours before departure: You are eligible for a 50% refund
- Less than 24 hours before departure: No refund will be issued
5.2 Weather Cancellations
In the case of unsafe weather conditions as decided by our captain, we will offer either:
- A rescheduling of your charter to the closest available slot without extra charges
- A full refund if rescheduling is impractical
5.3 Mechanical Issues
Should there be a technical issue with the yacht scheduled for your charter, we will attempt to arrange an appropriate replacement. If this is not possible, a complete refund will be offered.
6. Safety and Conduct
6.1 Safety Requirements
All guests are required to:
- Adhere to all instructions given by the crew
- Use provided safety equipment as needed
- Inform us of any health issues that might affect safety
- Stay within the designated areas on the vessel
6.2 Prohibited Items
Guests are not allowed to bring onboard:
- Glass items
- Illegal substances
- Weapons of any kind
- Excessive non-alcoholic drinks beyond reasonable personal consumption
- Pets, unless previously authorized
6.3 Conduct
We expect passengers to behave respectfully. Any passenger conduct that endangers safety or hinders the enjoyment of other guests may result in the immediate termination of the charter without a refund.
7. Liability and Insurance
7.1 Our Liability
Our accountability is restricted to the fees paid by you for the charter. We are not liable for:
- Injuries sustained from a passenger's negligence
- Personal belongings lost or damaged
- Unintended, consequential, or exemplary damages
- Delays prompted by weather or beyond our control
7.2 Insurance Coverage
Our fleet is covered by comprehensive maritime insurance. Passengers are accountable for their travel and personal insurance.
7.3 Assumption of Risk
Engaging in our charter services signifies your comprehension of the inherent risks associated with maritime activities, accepting individual responsibility for your safety.
8. Modifications and Itinerary Changes
Itineraries, routes, or schedules may be revised due to safety concerns, weather conditions, or operational needs. Comparable alternatives will be pursued wherever feasible.
9. Force Majeure
Circumstances out of our control that may lead to delays, cancellations, or changes in services include, but are not limited to:
- Extreme weather situations
- Natural calamities
- Government decrees
- Harbor shutdowns
- Technical malfunctions
10. Privacy and Data Protection
Your personal details will be managed as per our Privacy Policy. With the use of our services, you concur to the collection and application of your information in line with our Privacy Policy.
11. Intellectual Property
The material on our Service, such as text, designs, symbols, and photographs, is safeguarded by copyright and trademark statutes. Unauthorized reproduction, distribution, or creation of derivative works is prohibited without our express consent.
12. Governing Law
Applicable Monaco legislation governs these Terms. Any disputes are to be settled in the courts of Monte Carlo, Monaco.
